Background Information

Last year, Nebraska's long standing anti-corporate farm amendment was found by a United States Court to unconstitutional because it violated the "commerce clause" of the United States Constitution. Advocates and state senators have been working together to replace the amendment with a law that will pass constitutional muster. LB 1174 is that law. The bill is critical to ensuring Nebraska's assets benefit family farmers and ranchers by placing reasonable restrictions on corporate ownership of farm assets, while also making allowances for gnerational transfers and cooperative efforts of neighboring farmers.
